Conditions of hire
Fulfords Holiday Cottages (Fulfords) act
as agents for the property owner and the
contract of hire will be between the hirer
and the property owner
and shall be subject to these conditions
of hire.
1. Provisional reservations
can be accepted by telephone
and must be confirmed within 5 working days
by our
receipt of a completed booking form and your
remittance of
one third of total rent and booking fee. OVERSEAS VISITORS are required to
pay half the rental in advance together with
security
deposit. Payment by Credit Card only please. CREDIT
CARD CHARGE 2%, NO CHARGE FOR
SWITCH OR DELTA BEDIT CARDS,
PROVISIONAL BOOKINGS WILL BE AUTOMATICALLY
CANCELLED IF NOT
CONFIRMED WITHIN 5 DAYS
2. The security
deposit where applicable is due prior to the rental,
this being held against any charges incurred
as a result
of any breach by the tenants of the conditions (e.g.
breakages, damages, additional cleaning etc).
Where no
liability for charges is incurred, the security
deposit will
be returned within 21 working days (USUALLY
MUCH SOONER). You
will be responsible for any damage done to
the
property or its contents by yourselves, your
guests and
your pets.
3. Where Fulfords Holiday Cottages
accept security deposits they do so as agents, Fulfords Holiday Cottages cannot
act as arbitrator in any dispute between the owner and the tenant over the security
deposit. Such disputes shall be settled directly with the owner, for whose actions
Fulfords Holiday Cottages cannot accept responsibility.
4. When a provisional booking has been confirmed,
the
tenant is responsible for the total rent and
is due for
payment 6 weeks prior to the commencing holiday without further demand.
5. For bookings made less than 6 weeks before
arrival, the
total amount is due, to include full rental,
security
deposit and electricity/gas payments charged at summer rate 23rd
May – 18th September and winter rate at all other times.
6. A booking fee of £25.00
is payable on all bookings
7. HOLIDAY CANCELLATION INSURANCE –
You are required to take out Holiday Cancellation
Insurance to provide cover for the amount
payable in
the event of cancellation of your booking
before or
during your holiday through accident or illness
of any
member of your party. Evidence of such insurance
cover may be required. WHERE REASON FOR
CANCELLATION IS OUTSIDE THE COVER
OF ANY INSURANCE POLICY,
CANCELLATION CAN ONLY BE EFFECTED
BY ARRANGING A SUITABLE SUB-TENANCY
WITH THE OWNER OR THEIR
AGENT’S APPROVAL. THE AGENTS WILL
BE HAPPY TO ASSIST IN THIS MATTER FOR
A CHARGE OF 15% + VAT OF THE RENTAL.
YOU MUST PAY IN FULL AT THE TIME OF
BOOKING IF YOU DO NOT HAVE
INSURANCE.
8. Any complaints regarding the accommodation
or any shortage or defects, must be reported
by 5.00pm the Monday after arrival otherwise
we are unable to investigate the matter
properly. Neither Fulfords Holiday
Cottages or the owner of a property can accept responsibility for work taking place
outside the boundary of the property nor for any noise of nuisance arising from
works over which Fulfords Holiday Cottages or the owner have no control.
9. Whilst
every effort is taken to ensure the
accuracy of
the description of each property
and that
all
information given in this brochure is believed
to be
correct at the time of going to press, and
given in good
faith neither Fulfords Holiday Cottages
nor the property owners
accept
responsibility for errors. The property owners
cannot
accept liability for problems outside their
reasonable
control such as breakdowns of domestic appliances, plumbing etc, although every effort will be
made to
rectify problems as soon as possible.
10. Neither the property owners nor Fulfords Holiday
Cottages
accept
responsibility for injury to tenants, their
guests or third
parties (except in the case of death or personal
injury
resulting from negligence) or loss or damage
to
their belongings, any car or its contents.
11. TENANTS MAY COLLECT KEYS AFTER 2.00PM ON THE DAY OF ARRIVAL AND
MUST VACATE AND RETURN THE KEYS TO
FULFORDS BY 10AM (NO LATER) ON THE
DAY OF DEPARTURE. IF THESE TIMES ARE
NOT ADHERED TO, AN
EXTRA DAYS RENT
WILL BE CHARGED.
12. All occupants must be named on the booking
form. The tenant must not sublet the accommodation nor
share it
except with those named on the booking form.
The
property owners or their agents Fulfords Holiday
Cottages reserve
the
right to terminate the hire without notice
and without
refund if the number of occupiers is exceeded
or (at
their discretion) to make additional charge.
13. All bookings are from Saturday to Saturday
unless
otherwise stated.
Where Friday to Friday bookings
are
stated the rental will be as if it were from
the Saturday
to Saturday.
14. PETS, WHERE PERMITTED, ARE CHARGED £20
PER PET, PER WEEK. Pets are not to be left alone in the property and are not permitted in
the bedrooms or on the furniture. Pets are to be kept under control and exercised
off the premises.
15. The property and its fixtures and fittings, must be cleaned
by the tenant prior to departure. The tenant is responsible for any damages or breakages,
which should be reported to the owner or the agent during the period of occupancy.
Such loses or additional cleaning charges (if the property is left in an unsatisfactory
condition) will be billed to the tenant.
16. Prospective tenants must contact the owner’s
agents if
they wish to satisfy themselves as to any point
of particular
concern such as disabled access.
Any
responses to requests for information are subject
to
clause 8 above.
17. Any articles of value left by the tenants
if located can
be forwarded on receipt of a minimum handling
fee of £10.00 plus P&P.
18. The Tenancy created by this agreement is
a Holiday Let
within paragraph 9 of Part 1 to schedule 1
of the
Housing Act 1988.
19. You will be required to sign a disclaimer
for properties
with a swimming pool.
20. Amendments or alterations to the holiday
booking at
your request or a re-issue of the confirmation
due to
loss of the original will be subject to a £30
administration fee.
21. These conditions supersede
all those issued before.
22. If for any reason beyond the owners control the property
is not available on the date booked, all rent and charges paid in advance by the
tenant will be refunded in full, but the tenant shall have no further claim against
the owner or agent.
23. Some properties provide bed linen and towels some do not,
Fulfords Holiday Cottages strongly advises tenants to check property details at
time of booking.
24. Bookings will not be accepted from groups of single people
under the age of 25.
25. The agents are responsible to the owners for the collection
of rentals only and no claims regarding the accommodation will be accepted by the
agents.
